Can I sue my employer for a work injury?

Workers who are injured on the job often hear that they cannot sue their employers. While this is true in most cases, injured workers may have the right to sue in some cases.

Georgia workers who are injured on the job are entitled to income and medical care benefits from workers' compensation regardless of who was at fault. However, if someone else was at fault, workers' compensation may not be your sole source of recovery.

In exchange for providing workers' compensation Georgia employers are protected from employee lawsuits for injuries that happen on the job. However, third parties such as contractors and suppliers who do not work for your employer are not protected.

If the injury was caused by a third party, you may be able to recover compensation for losses not covered by workers' compensation (such as pain and suffering), by filing a personal injury lawsuit. Here are examples of third parties who may be sued if they injure you:
